ROC welcomes high initial compliance rate for new ORP disclosure obligations

Under a new legislative requirement, registered organisations and branches are required to provide an Officer and Related Party (ORP) Disclosure Statement to their members and the ROC within six months of their financial year ending. 

The Fair Work (Registered Organisations) Act 2009 requires organisations and branches to prepare an ORP statement detailing such items as relevant remuneration, non-cash benefits and payments to related parties and declared persons or bodies.

As part of our 2018-2019 Education Strategy, the ROC launched a range of new and updated educational resources tailored to ORP disclosure statements during which we actively engaged with organisations and branches by providing updated guidance notes, a reporting template, a new webinar and other online materials to increase understanding about ORP statements.

Organisations and their branches with financial years that ended on 30 June 2018 were required to lodge a disclosure statement by 31 December last year and following a comprehensive education and reminder campaign, a pleasing initial compliance rate of 91% was achieved. As a result of further intensive engagement between the ROC and those organisations that did not initially comply, 100% of organisations and their branches with financial years that ended on 30 June 2018 have now lodged their ORP disclosure statements.

“As part of our concerted education approach, we wrote to unions and employer associations alerting them to the new and changed disclosure obligations, provided access to a reporting template, guidance note and fact sheet while also reminding them of the 31 December deadline,” said Registered Organisations Commissioner Mr Mark Bielecki. 

"An initial compliance rate of 91% is a very positive outcome for a new reporting obligation and it reinforces our experience that the vast majority of organisations are interested in voluntary compliance. I wish to thank registered organisations, their branches and officers for their on-going efforts and the ROC looks forward to working closely with them this year as part of our on-going education campaign to elevate the initial response rate even further,” said Mr Bielecki.

Organisations and branches with a financial year ending 30 September 2018 are next due to lodge disclosure statements by the end of March this year.

Mr Bielecki said the ROC remains focused on helping registered organisations understand the requirements of the Act, adding that “our priority remains on education and promoting voluntary compliance, and this has been supplemented by our national 2018-19 Education Strategy which schedules the release of education and information material and events to help organisations plan ahead and select those tools which will help them become more familiar with their obligations and to upskill.”
